5. Delivery of product(s)
We will deliver the buyers product(s) to the delivery address specified in the email.
Delivery will be made as soon as possible, which is usually a matter of days, but in effect can be anywhere between from 1 to 42 days of the order being placed. If you do not receive your order within 42 days you are entitled to cancel the order for non-delivery.
All deliveries require CHECKING and a SIGNATURE to state the order has been ‘received in good condition’. Please open and inspect goods in the presence of the delivery driver, as courier companies will accept no responsibility for damage after the driver has left.
Once the order has been delivered, the buyer will become the owner of the product(s) and will be held at the RISK of the buyer. At this point Kenross Fireplaces will not be liable for loss or destruction of product(s).
Kenross Fireplaces will have no liability for any failure to deliver goods, any delay in doing so, for any damage or for any defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, floods, fires, explosions or natural disasters.
Kenross Fireplaces do NOT accept return of unwanted products.
Buyers cannot return product(s) ordered that have been installed or the product(s) has been damaged through accident, neglect, misuse, unauthorised alteration or attempted repair.
Twelve Month Manufacturers Guarantee
All products purchased at Kenross Fireplaces come with a minimum twelve month manufacturer’s guarantee. Any claim brought by you under this guarantee is to be made directly to the manufacturer of the product, not Kenross Fireplaces.
Kenross Fireplaces Online accepts no liability under the manufacturers guarantee and gives no warranty in this respect.
In the case product(s) become faulty it is the manufacturer’s responsibility to repair or replace the product within the 12 month period.
Damaged or Inadequate Delivery
If product(s) we deliver are not in accordance to those specified in the order, are damaged or defective or if the delivery is of an incorrect quantity, we shall have no liability unless the buyer notifies us within 48 hours of the delivery of the product(s) in question.
If a buyer notifies a problem to us under this condition, our only obligation will be to either:
Make good any shortage on non-delivery; or
Replace or repair any goods that are damaged or defective; or
Refund the payment for the product(s) in question in whatever way we chose.
We will not be liable for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) arising out of any problem notified to us under this condition.
We shall have no liability to pay any money by way of compensation other than the refund to the amount paid by for the product(s) in question.
7. Cancellation by Us
We reserve the right to cancel an order if:
We have insufficient stock to deliver product(s) that have been ordered
One or more of the products ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
If we need to cancel an order, we will notify the buyer by email and will re-credit any sum deducted by us from the buyer’s credit card as soon as possible.
We are not obliged to offer any additional compensation for disappointment suffered.
8. Installation
Kenross Fireplaces does not install product(s), but are happy to provide you with information about installers in your area. Please contact us for more information.
For your safety the UK law stipulates that all gas appliances must be installed and serviced by a CORGI Registered installer.
9. Privacy Policy
Kenross Fireplaces is committed to protecting privacy. We shall only use personal information for the processing of orders and delivery of goods.
Under the Data Protection Act, we shall never disclose, sell or trade personal information to third parties. We will not hold any credit/debit card details longer than is necessary to complete the transaction, after which these details are deleted.
